OFFICIAL MINUTES OF THE CITY COUNCIL OF THE CITY OF WEST PEORIA, ILLINOIS TUESDAY, JULY 14, 2009 7:00 P.M. WEST PEORIA CITY HALL 2506 WEST ROHMANN AVENUE, WEST PEORIA ILLINOIS
A Regular Meeting of the City Council of the City of West Peoria, Illinois was held at the West Peoria City Hall on July 14, 2009. Mayor Dillon thanked everyone for attending the City Council Meeting and reminded everyone that this will be aired on Channel 22 at 8:00 p.m. on Wednesday July 15th.
1. CALL TO ORDER
Meeting was called to order at 7:00 p.m.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Dillon.
3. ROLL CALL The following members were present: Alderman Dohm, Alderman Dwyer, Alderman Ganson, Alderman Mathewson, Alderman Meismer, Alderman O’Neill, Alderwoman Thomas, Alderman Venzon, and Mayor Dillon. Also present were City Administrator Carlson, City Attorney Connor, City Clerk Stephens, Economic Developer Pratt, Rolland Reinhart, Township Supervisor DeSutter, ZBA Chair McBride, Carl Benedict, Dave Etnier and Donald Neill.

5. APPROVAL OF MINUTES
Motion was made by Alderman Dohm and seconded by Alderman Ganson to approve the minutes of the Regular Meeting held June 23, 2009. ROLL CALL VOTE – Ayes – Dohm, Ganson, Dwyer, Mathewson, Meismer, O’Neill, Thomas, Venzon Nays – 0 Absent – 0 Motion carried.
6. COMMUNITY POLICE REPORT
Officer Watkins was absent. No Report
7. MAYOR’S REPORT
Mayor Dillon thanked everyone who attended or was involved in the 4th of July Parade. Mayor Dillon said: Unfortunately it rained, but the Parade went on as scheduled. The Marching Band said they are used to marching and playing in the rain. The members of the Clonmel Band were amazed at the number of residents that came to the parade. Mayor Dillon and all eight City Council Member walked the parade with Peoria Mayor Ardis and some of the City Council Members from Peoria. Also marching was: State Representative Jehan Jordon, State Senator Dave Koehler, Congressman Aaron Schock and Illniois Comptroller Dan Hynes. At the end of the parade as always was Mayor Maloof . The Clonmel Marching Band won the over all Trophy. Mayor Dillon asked Gene Pratt to show the Poster that every band member and every host adult signed and wrote a message. This will be mounted and hung in City Hall. There is a duplicate Poster that will be signed and sent to Clonmel with all the West Peoria City Hall Staff, Council Members and Elected Officials. Mayor Dillon said there are a few alleys in West Peoria that are to be seal coated. When was no rain in the forecast and the first phase of the process and water based oil was put down as a primer and then it rained. The final coat cannot be put down until it is dry with two days of no rain. We apologize for the delay and as soon we have dry weather the alleys will be completed.

9. MOTION TO APPROVE ORDINANCE NO. 2009-15 AN ORDINANCE APPROVING A TRANSFER OF JURISIDICTION FROM THE COUNTY OF PEORIA TO THE CITY OF WEST PEORA, ILLINOIS FOR A PORTION OF ROHMANN AVENUE FROM ASHLAND AVENUE TO SWORDS AVENUE AND SWORDS AVENUE FROM ROHMANN AVENUE TO KENWOOD AVENUE was made by Alderman Venzon and seconded by Alderman Ganson. Discussion: Attorney Connor this Ordinance is familiar, it was returned by the State because it did not match perfectly with the State’s description of the area involved. We took this information off of the Jurisdictional Transfer. This just needs to be re-approved and send it back to the State.

10. A MOTION TO APPROVE THE HEALTH INSURANCE RENEWAL was made by Alderman Mathewson and seconded by Alderman Meismer. Discussion: Alderman Mathewson said that the premium is higher than in the past, this is still under what we budgeted.

11. MOTION TO APPROVE ARCHITECT LONTAI’S INVOICE (Line Item 01-11-820 Capital Outlay) in the amount of $7,476.80 was made by Alderman Mathewson and seconded by Alderman Meismer.

12. WELCOME WALL LANDSCAPING Economic Developer Gene Pratt passed out copies of the bids for the Landscaping for the Welcome Wall. Gene stated now that the street light has been removed the only thing left to complete this project is the landscaping. Jan Powers and I met with the representative from Chambers and Sons Landscaping. His proposal is a modification of what was originally asked for. Mayor Dillon asked if Chambers bid was a prevailing wage. Alderman Mathewson asked if height of trees/shrubs would be a problem. Mayor Dillon asked for a motion for the two stipulations: 1) Prevailing Wage 2) Height of trees/shrubs
Alderman Mathewson suggested to table this until the next City Council Meeting to see if these issues get resolved. Alderman Dohm said that the Land Use Committee will meet tomorrow night, July 15th, we can put this on the agenda for discussion only and bring it back to City Council. Motion to table this was approved.
13. ANNEXATION REQUEST Discussion: Attorney Connor said that at the last City Council Meeting there was a presentation made by the Developer of the Babu Project and he is here tonight to see if there is any interest in moving forward with negotiations for Annexation Agreement. If is your pleasure it would be appropriate to have motion to proceed with Annexation Agreement Negotiations on this development and second to have a discussion. Alderman Dohm made the motion to precede negotiation and have a discussion Alderman Dwyer seconded. Discussion: Alderman Dohm asked was this a request by Babu Development to the Council? Mayor Dillon: Yes Alderman Ganson asked if the request to enter into Annexation Agreement that was in our packet for tonight’s meeting was a draft instead of an Agreement. Mayor Dillon: Yes Attorney Connor said that the Annexation Agreement requires a Public Hearing to be held by the City Council after a fair amount of notice. I would recommend that the City Council rely on the City Staff and Mayor to put together a proposal and circulate it to the Council for their review and the Council provide individual feedback. I would advise you not to vote on this until an appropriate Hearing has been held. Alderman Dohm: Are there any variations that we would have to use one of our newer Ordinances that would require ZBA? Attorney Conner: Yes Attorney Connor stated that there is a motion on the floor to being negotiation or annexation agreements. City Administrator Carlson asked Attorney Connor if he would design a flow chart upon approval. Attorney Connor: Yes

14. United Disciples Church Discussion: Attorney Connor said he spoke with the Attorney for the Church and the Church has requested the City of West Peoria pay all the closing cost of the transfer including the Church’s Attorney fees. The current status: Mr. Heiple is representing the Church. He will draft the deed to the Church, whereby the Church would deed it to the City. I will put together a one page agreement for the $1.00. I am looking for your general feeling on the moving forward under these terms. Alderman Dohm: Do you have a general idea of the figures? Attorney Connor the transfer fees will be minimal this is all based upon the purchase price. I would have to speculate. Alderman Venzon: Is $5,000 is a good figure for all the combined fees? Attorney Connor: I think that would be plenty high. Alderman Ganson made a motion to approve this project for not more than $5,001 and seconded by Alderman Venzon. Discussion: City Administrator Carlson stated that the City of West Peoria and the West Peoria Township purchased the kitchen equipment and the pews. Mayor Dillon suggested a Building Committee Meeting.

15. CONSIDERATION AND POSSIBLE VOTE ON APPLICATION FOR SPECIAL USE PERMIT FOR CARL BENEDICT Alderman Dohm made a motion to concur with the Zoning Board of Appeals with their Findings of Facts this was seconded by Alderman Dwyer. Mayor Dillon described the Special Use Meetings: Mayor Dillion informed everyone at this meeting the only evidence taken has already been taken before the Zoning Board of Appeals. Tonight there can be no new witnesses, exhibits, no new testimony by a witness who has testified before the ZBA. He can present arguments based on the evidence which is present here tonight and the testimony shown in the ZBA minutes. Council members you are to make your decision based on the evidence and testimony as shown in the minutes of ZBA Hearing. If you need a question that is not answered by the evidence of the ZBA minutes you can send the matter back to the ZBA for further hearings. Mayor Dillon said to Mr. Benedict if you violate the rules or simply repeat the evidence of the Zoning Board of Appeals, we have a five minute time limit. Mr. Benedict passed out pictures of Benedict Car Lot that were shown at the ZBA meeting. These pictures were taken right before the Zoning Board of Appeals meeting. Gene Pratt passed out pictures of the Benedict Car Lot taken the morning of the Zoning Board of Appeals meeting, which were also shown at the ZBA meeting. Carl Benedict complained about the inspection of his property by the City of West Peoria. Mr. Dave Etnier – Friend and Business Broker gave his testimony of Carl Benedict as an businessman. Mayor Dillon asked if any members of the City Council had any questions for Mr. Benedict. Mr. Benedict asked if the Council would vote on this tonight. Mayor said that there is a motion and a second on the floor tonight. The Council can vote on this tonight or they could send it back to the Zoning Board of Appeals. He told Mr. Benedict that there have been on going problems for years and that he has not complied with West Peoria Codes and bringing his business up to standards. Gene Pratt added that Mr. Benedict is still not in compliance in a variety of ways and still outside of the boundaries that he is allow to have by the State of Illinois. The City has worked with Mr. Benedict in a number of ways. Alderman Dohm asked Chair McBride of Zoning Board of Appeals if there were any questions she would like to bring up. Chair McBride answered no. Motion to concur with the Zoning Board Appeals was made by Alderman Dohm and seconded Alderman Dwyer. A vote yes concurs with the Zoning Board of Appeals

The application was denied. Mr. Benedict was advised he could fill out a Freedom of Information Act.
16. A MOTION TO APPROVE PPUATS DUE (LINE ITEM 17-00-543 MFT) IN THE AMOUNT OF $1,837.92 was made by Alderman Venzon and seconded by Alderman Ganson. Discussion: Alderman Venzon said this is annual dues.

17. MOTION TO APPROVE PAYMENT TO HOROWITZ CONCRETE Co.IN THE AMOUNT OF $9,300 FOR THE HEADING AVENUE PROJECT (LINE ITEM 01-41-860) was made by Alderman Venzon and seconded by Alderman Ganson.

19. COMMITTEE REPORTS A. FINANCE COMMITTEE REPORT – The Finance Committee met on July 7. The committee went over the Financial Report, discussed Architect’s Lontai Invoice, reviewed the Health Insurance Renewal, we discussed the new building and the financial end. The Committee discussed the new building. Our next meeting will be August 4th 2009, at 5:30 at City Hall.
B. LAND USE COMMITTEE REPORT – The Land Used Committee has not met since the last City Council Meeting. The next meeting of the Land Use Committee will be July 15, at 6:30 p.m. at City Hall.
C. PUBLIC SAFETY COMMITTEE REPORT – The Public Safety Committee has not met since the last City Council Meeting. The next meeting of Public Safety Committee with be July 15, at 5:30 at City Hall
D. TRANSPORTATION COMMITTEE REPORT - The Transportation met The Committee worked on the Ordinance 2009-15 of the Jurisdiction Transfer from the County of Peoria to the City of West Peoria, we discussed PPUATS dues, payments to Horowitz Concrete Co., we checked out our Storm Damage Policy, and met with a couple residents on Ashland Avenue to coordinator a Sidewalk project with the reconstruction the Ashland Avenue. Our next meeting is here at City Hall on August 13, 2009 at 6:30 p.m.
13. PUBLIC COMMENT Mayor Dillon commented that now the Governor has passed the Capital Bill, hopefully we are going to get a small amount of money for infrastructural improvement. Our State Representative Jehan Jordon is going to hold a Town Hall Meeting in West Peoria at City Hall on July 22, 2009 at 6:30p.m.

Motion was made by Alderman O’Neill seconded by Alderman Ganson to adjourn. Motion carried unanimously by voice vote. Meeting adjourned at 8:02 p.m.
