     A Regular Meeting of the City Council of the City of West Peoria, Illinois was held at West Peoria 

     City Hall on April 27, 2010.

                 David Pittman presented his testimony. I have heard public hearings described  

                 in a variety of ways; some good, usually bad. Often I think Public hearings are

                 only a platform for pre-determined posturing and argument where emotions

                 and efforts at persuasion are far more important to the participants than any

                 listening. Public hearings by municipal bodies are often rituals of information  

                 transmission quickly followed by decision-making. What they are not, is very

                 easy to describe. What they could be, if a community was truly engaged in the

                 democratic process would be a place for people to listen to each other, in

                 public, without the time pressure of imminent voting, to learn from each other

                 and seek shared agreement.

                 It is not my plan tonight to persuade you, or argue or angrily denounce the

                 process. I want to engage you in discussion on the impact this annexation

                 contemplates on our West Peoria community. I hope to offer some food for

                 thought as this Commission looks at all possible ramifications of the proposed

                 re-zoning. In this small town we have a chance to get democracy done right,

                 face to face with a civil exchange. I am aware that the legal boundaries of this

                 discussion are about zoning classifications, and that the actual decision of    

                 annexation will occur at only one place, City Council.

                 I will ask one fairly obvious question that has many possible answers. Then I

                 will ask several economic and historic land use questions that I hope will have

                 fairly direct and straight forward answers. The final half of my testimony will 

                 be to propose the Planning Commission review the best use of the portion of

                 these  properties that are in floodplain and thus subject to very limited

                 development options. I have provided each of you, I hope, with these remarks

                 ahead of time, so that if there is to be discussion tonight, there was time to

                 contemplate and answer the questions.

 

                 WHAT IF BABU PRAKASH DEVELOPMENT IS POSTPONED OR DOES   

                 NOT OCCUR?                                                                                            

                 Annexation of the four properties discussed tonight has been planned and is

                 predicated on the presumed successful outcome of Babu Prakash property

                 development. A TIF District connection has been discussed through a portion  

                 of this annexation area in order to physically connect with the anticipated

                 development. Re-zoning is based on that anticipation. Reviewing the past

                 months minutes of Planning Commission and City Council, I do not see any

                 public mention of these properties except in the context of the Babu Prakash

                 development.                                                        

                 So what happens if the Babu development does not occur or is postponed? 

                 How will our community be impacted, good and bad, if these property

                 annexations occur tonight but no other change occurs? What if these properties

                 in discussion tonight are eventually sold, and new owners determine to seek

                 new zoning? What precedent if any is set by the proposed efforts tonight? I

                 offer these pragmatic, economic questions, not because I am seeking delay or

                 because I know of any smoking guns. I really do not expect my taxes to be

                 dramatically impacted, good or bad. It is my hope you will be able to give a

                 knowledgeable response, for the public record.

 

                 GEOGRAPHIC AREA CHANGES TO WEST PEORIA                                   

                 West Peoria annexation of this land increases the city size by 310 acres or 0.48

                 square miles. Our current City area of 1.3 square miles increases to 1.78 square

                 miles, and the Population density of West Peoria will decrease from 3703

                 people per square mile to 2675. This is a change of nearly 30%. What does this

                 do to West Peoria access to public funding sources, especially state & federal

                 agency grants? Is it a disadvantage to be roughly the same population density

                 as Peoria or Peoria Heights ( 2500 people / square mile)? 

 

                 SERVICES, REVENUE & EXPENSES WITH THE ANNEXED PROPERTIES

                 How much will our roadway responsibility increase, separate from the Babu

                 property? What type of roadway maintenance and what additional security

                 services, if any, will be required by this annexation? Will West Peoria have

                 any responsibility for example, with Kickapoo Creek Road maintenance, or

                 liability for portions of Kickapoo Creek erosion? Will there be new funding

                 opportunities? What discussions, if any, have occurred regarding the interface  

                 of two fire districts and two townships with this annexation? How much

                 anticipated revenue will be obtained by this annexation, separately calculated

                 from the Babu Prakash development?

 

                 FLOODING, COAL MINES AND ILLEGAL DUMPING HISTORY                      

                 What is the commercial history of the properties, and do they carry significant

                 liability from the consequences of past use and exposure to natural disaster?

                 Has there been any discussion regarding Federal Emergency Management

                 Authority involvement in the past with these areas? Does the Planning

                 Commission have documentation of the past major flood events of the

                 properties under discussion tonight?                             

                 Areas of Kickapoo Creek have been developed for over 150 years, and    

                 historically been subjected to mining of its shallow coal seams that were easily

                 accessed. In Peoria County there are over 600 identified coal mines, according

                 the Illinois State Geological Survey. Some of them existed along Kickapoo

                 Creek. It is common knowledge that coal was mined along Kickapoo Creek for

                 at least 70 years. Are any of these now abandoned mine shafts on the subject

                 properties, what is the subsequent liability and obligation, if any, inherited by

                 West Peoria residents  by annexation into the City?

                 Illegal dumping has always occurred along Kickapoo Creek. And still does.

                 Has any effort been made to survey the property and identify these areas? Just  

                 north of Farmington Road on Kickapoo Creek, old automobiles can be seen

                 half buried along the riverbanks. That property is not part of this annexation,

                 but may give us a hint of what else lies along the Kickapoo stream banks. Does

                 annexation of this property, especially the public land, transfer responsibility

                 for hazardous waste cleanup, if problems exist? As a purely abstract example,

                 what if abandoned toxic waste was identified on the Peoria County property

                 after annexation occurs. Who would pay the bill for clean-up?

 

                 BEST USE & ZONING; CONSERVATION IN THE FLOOD PLAIN

                 Much of the acreage under discussion is in floodplain, and subject to significant

                 development restrictions. Construction of permanent structures including roadways

                 will need to be carefully evaluated and in many cases, restricted. But just as one door

                 closes and another opens, please consider the potential for multiple use  recreation on

                 the floodplain properties, which by my guess consists of at least 150 acres, or 1/2  the

                 total area. There exist significant unique natural features on some of these parcels that have

                 been recognized by the Illinois Department of Natural Resources as valuable to the ecological

                 heritage of our area. Appropriate zoning should reflect this and allow reasonable, best use

                 without harming these important features. Development of a Conservation Overlay District for

                 these floodplain areas seems very appropriate for the Planning Commission, as has been done

                 with other areas of West Peoria.

 

                 ROCKY GLEN

                 Those features include a Starved Rock look-alike box canyon with two waterfalls which locals

                 call Rocky Glen, located on a portion of the Connaughton property.  Here is a handout for the

                 record that includes newspaper stories from the 1940s describing the picnics that occurred under

                 previous owners. There is also an IDNR description of Rocky Glen, dated 1978. The area is not

                 only unique geologically, it is also biologically important, and listed in the Illinois Natural Areas

                 Inventory of 1978 then reviewed in 2003.  Graduate students from the University of Illinois have

                 studied the mosses, ferns and plant community. There is truly nothing else like it in central Illinois,

                 and zoning should reflect this important intrinsic value to the community.

 

                 NEARBY PEORIA PARK DISTRICT PROPERTIES

                 This annexation will include land that is adjacent to large tracts of Peoria Park District property.

                 GPSD land abuts 20 acres of Madison Park bluff woodland, and the Connaughton  property abuts

                 55 acres of beautiful wooded PPD land, which the Park District calls Rocky Glen.

                 To the north of Farmington Road the PPD owns 72 acres of creek frontage called Aspen Hills. The

                 potential exists for linking all of these areas together to establish a recreational greenway along

                 Kickapoo Creek for nearly 2 miles between Pottstown Road and Airport Road.

 

                 RECREATIONAL USE; BIKING, HIKING AND FISHING

                 In the next five years there will be construction on a bike trail from Airport Road west to Hanna City

                 and Farmington and Trivoli, along a now abandoned rail corridor owned by IDNR. They are

                 developing their construction plans with the Tri-Country Regional Planning Commission. Many of the

                 rails have already been removed and locals are using the gravel walkway already for recreation in

                 Hanna City. Connecting the eastern trailhead of this recreational trail with Farmington Road would be

                 a matter of 1.5 miles, north from Airport Road

 

                 HIKING & FISHING

                 I would urge the Commission to evaluate in future meetings the opportunities West Peoria has to

                 develop recreational hiking trails along this floodplain land. The Sanitary District has always

                 demonstrated their  willingness to be good stewards of their 160 acres of  Horseshoe Bottoms.

                 The Peoria County property and the creek’s edge portion of the Hamilton property may also provide  

                 opportunities for this low impact outdoor recreation. Together these trails would allow public hiking

                 and fishing opportunities that are completely unique to the Peoria area over primarily easy terrain,

                 alongside moving water in a wooded setting.

 

                 WILDLIFE PRAIRIE PARK

                 As some of you know, Wildlife Prairie Park and the Tri-County Regional Planning Commission have

                 studied the possibility of seasonal canoe trips along Kickapoo Creek downstream to Bartonville. The 

                 recreational potential of stream access for kayaks, canoes and water recreation in this annexation

                 property should be explored. There is nothing else like this in our area, and would prove popular with

                 folks who want to be outdoors in the water.

 

                 Thank you for allowing me to speak at such length. Annexation of these properties is a dramatic step

                 for our City, and no one here tonight can see all of the implications. We do know that  Zoning will

                 direct land use, and the Planning Commission will I hope, accept the responsibility of looking as far

                 into the future as they possibly can, relying on the positive conservation values stated in the 2008 City    

                 Comprehensive Plan in Goal Number 5, Open Space and Natural Resources.

                 Green corridors do many things for communities. They improve air quality, reduce pollution, increase

                 property values and build a better sense of place. They control sprawl and encourage smart

                 development. In many tangible ways, conservation zoning emphasis in the annexation properties

                 floodplain can improve the elusive quality of life goal that we all share for West Peoria. In survey

                 after survey, homeowners indicate they want to live near public parks and recreation area. This

                 annexation tonight represents an opportunity, completely separate from the Babu Prakash development  

                 opportunity, that I hope this commission will recognize and support in every way possible. Thank you.

 

            d. Mr. James Connaughton

                Bartonville, IL   61607

       

                Mr. James Connaughton began his presentation by stating since the 1970’s the Park District has

                been interested in his property and has been to this property several times. I have developed this

                property on and off over the last ten years it has always been an environmental problem with

                people dumping their trash and old tires. Until you have grounds rules to enforce and to preserve

                this type of area you will have this problem. The reason I considered Annexation is the Temple is not

                recognized too well at the bottom of the hill. On this side of West Peoria you must think this will be a

                great plus to the area. This property could be ten to fifteen years and still sitting  in Limbo before it is

                developed. It is only a plus if you develop that area and do it right. 

                My property is the closest area to Starved Rock for rock formation it is no Starved Rock but it is

                unique to Peoria. Mr. Connaughton told the City Council there cannot be two ways to go with this,

                either recreational or have it developed.

    

                Mayor Dillon said the City is talking about annexing the property now. Mayor Dillon told Mr.

                Connaughton this is his property to do what you want to do with it. We will work with you, but you

                are the owner of the property and the only one who can control this, even with the annexation, is you.

                Mayor Dillon told Mr. Connaughton the Economic Development Coordinator Gene Pratt has talked to

                you in depth and that many of the things that were brought here tonight  were answered by the

                committees and meetings. Mayor Dillon stated there is a lot of potential that can be developed and

                this depends on which way you go with your property. We can all sit here and tell you that you should

                do this or do that, the bottom line is you own that property and I believe the majority of  this Council

                believes it is the right of the person owning that property, and the bottom line is you.

 

                Mr. Connaughton stated: this touches on another area. I have lived in the Limestone area for ten years

                and I am concerned about Limestone, there is no structure at all.  Mr. Connaughton asked if the City of

                Peoria has a mile and a half buffer zone into the City of West Peoria?

                Mayor Dillon answered yes; the way I understand is each of the municipalities has a mile and a half

                buffer zone.

        

                Attorney Connor: They call this Planning Jurisdiction under the sub-division requirements.

                Mr. Connaughton asked if the City of Peoria can designate their codes to City of West Peoria.

                Attorney Connor: Once you annexed into the City of West Peoria that won’t exist and the City

                Council is planning to vote on your annexation at tonight’s meeting.

                Mayor Dillon said we will sign the papers and record them..

                Mr. Connaughton said West Peoria has been good to him

                Attorney Connor asked Mr. Connaughton if there were any electors living on his property?

                Mr. Connaughton answered no.

                Attorney Connor asked Mr. Connaughton if he or his sister-in-law Patricia Connaughton are

                co-owners of this property you petition to annex into the City of West Peoria.

                Mr. Connaughton answered yes.

    8. COMMUNITY POLICE REPORT

        Officer James Middlemas reported a string of related residential burglaries in West Peoria Officer

        Middlemas and the Peoria County Sheriff’s Department are working diligently to solve these

        burglaries. There are no suspects at the present time. He asked if anyone knows anything about these  

        burglaries or sees anyone or anything that looks suspicious please contact the Peoria County Sheriff.

 

    9. MAYOR’S REPORT

        Mayor Dillon reported on the meeting he attended a meeting with some representatives about the 

        video poker machines. He stated the State of Illinois is legalizing the video poker machines, setting up

        rules and hope to have every thing in place by the end of this year. The State has hired State Police to

        start doing the back ground checks, when this goes into effect the business owner will have to be

        licensed. This very high tech and expensive, the establishments will have to apply and will have to

        upgrade their electrical systems to be able to have these machines which will be on a limited basis.

        Mayor Dillon told the council about the meeting he attended with the County on the PAWS with

        several other Mayors from different Municipalities. State’s Attorney Kevin Lyons attended this

        meeting and  will be prosecuted by the States Attorney’s Office, the municipalities will not have to

        take care of this. City Administrator Carlson drafted a letter to the entire establishments that have a

        Liquor License in West Peoria. Mayor Dillon said that all the establishments have been forewarned.

        Clean Up Day was a success and thanked everyone who came out and helped, the City and Township

        work together with this endeavor. Government Day is April 30th, Students from Manual and Notre

        Dame High Schools and students from Calvin Coolidge and St. Marks Grade School will attend.

        City Treasurer Jennifer Main distributed the March, 2010 Treasurer’s Report. A motion to Receive

        and File this Report was made by Alderman Mathewson and seconded by Alderman Meismer.

     12.  MOTION TO APPROVE ORDINANCE 2010-02 AN ORDINANCE AMENDING SECTION

            2-3-1 AND ADDING A SECTION 2-5-3 AGRICULTURAL DISTRICT TO THE WEST

            PEORIA CITY CODE was made by Alderman Dohm and seconded by Aldermen Dwyer and

            Alderman Mathewson

            Discussion: City Attorney Connor commented the Sanitary District has culture use there and

            is not growing crops and other types of natural uses of their property. They were willing to annex to

            West Peoria but wanted to maintain the growing crop capabilities. However they also have a

            potential further use for that property, which is probably why they bought it is the first place, they may

            construct a facility there at some point in the future. Through various discussion with the Sanitary

            District we came up with the idea and the Plan Commission approved to create an A-1 District

            also had all the R-2 things which is the only one that has the Sanitary District type facilities in it as a

            Special Use. This is a one size that fits both of these needs.

        Discussion:  Alderman Dwyer stated that this Classification is so that the Race Track can continue to

        operate as they have in the past.

        Discussion: Alderman Dohm asked if this was just to amend the fee schedule.

        Attorney Connor said this will do two things – it will add a Class J License and gives a fee for that

        amount.  This will be same fee as the “A” “B” “C” License.

        Discussion: Alderman Dohm asked if this restricted to just one piece of   property.

        Attorney Connor said there is a description; there could be other pieces of property that meets that

        description but not many.

        Alderman Mathewson asked if they would have to notify the City with these control burns.

        Mayor Dillon said yes.

        MAY 1, 2010 AND ENDING APRIL 30, 2011 was made by Alderman Mathewson and seconded

        by Alderman Meismer.

        Discussion:  Alderman Mathewson  stated the Budget has been on display at West Peoria City Hall

        and thanked City Administrator Carlson and Staff for doing a very difficult job in a tight situation.

        Discussion: Mayor Dillon said in the past we have always had the contract with PAWS and

        now this is with Peoria County; the contract amount went down this year. What Peoria County is

        trying to do, by 2014 the municipalities that are paying into will no longer have to have a line item it

        will be taken out of their Public Safety Tax.

         Discussion: Alderman Dwyer asked for the time line for Ashland.

         Alderman Venzon said this will be done before the end of the construction season.

  33.  COMMITTEE REPORTS

 

      A. FINANCE COMMITTEE

                 Chair Mathewson the Finance Committee has not met since the last City Council Meeting.

                 Our next meeting will be May 4th, 5:30 at City Hall.

 

            B. LAND USE COMMITTEE

                Chair Dohm reported the Land Use Committee met last week and discussed the annexations.

                The Committee did not get the Height Variance Change to Planning in time. The Committee was

                informed on some changes in Waste Management. Our next meeting will be May 19th at

                6:30 p.m. at City Hall

          

     C. PUBLIC SAFETY COMMITTEE

          Chair Dwyer reported the Public Safety Committee met last week and discussed Waste

          Management. Our contract with them is up next November. We discussed the possibilities

          about recycling and also about Animal Control Agreement. Our next meeting will be May 19th at

          5:30 p.m. at City Hall.

       

           D. TRANSPORTATION COMMITTEE

                Chair Venzon reported the Transportation Committee has not met since the last City Council

                meeting. Our next meeting is May 15th, at 6:30 p.m. at City Hall.
