OFFICIAL MINUTES OF THE WEST PEORIA CITY COUNCIL APRIL 13, 2010, AT 6:30 P.M. WEST PEORIA CITY HALL 2506 W. ROHMANN AVENUE WEST PEORIA IL
A regular meeting of the City Council of West Peoria, Illinois, was held at the West Peoria City Hall on April 13, 2010.
1. CALL TO ORDER Meeting was called to order at 6:32 p.m. by Mayor Dillon.
2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Dillon.
3. ROLL CALL The following members were present: Mayor Dillon, Alderman Dohm, Alderman Dwyer, Alderman Ganson, Alderman Mathewson, Alderman O’Neill, Alderwoman Thomas, Alderman Venzon, City Administrator Carlson, City Attorney Connor, Economic Development Coordinator Pratt, City Clerk Stephens. Also attending Township Supervisor DeSutter, Rolland Reinhart, Street Department Manager Strube, Township Kennedy, Plan Commission McBride, Township Kelch, Township Abraham. Absent Alderman Meismer
4. ADDITIONS TO OR DELETIONS FROM AGENDA None
5. APPROVAL OF MINUTES Motion to approve the minutes from the March 23, 2010 City Council Meeting was made by Alderman Dohm and seconded by Alderwoman Thomas.
ROLL CALL VOTE Ayes – 7 Dohm, Thomas, Dwyer, Ganson, Mathewson, O’Neill, Venzon Nays – 0 Absent – 1 Alderman Meismer Motion Carried
6. COMMUNITY POLICE REPORT Lt. Hartwig gave the report in the absence of Deputy Middlemas. He reported on the recent attempted home break-ins in West Peoria and suggest more security lights on the outside on the residents home. Deputy Middlemas will come to the resident’s home and suggest the best place to put the security lights and check the door locks. Mayor Dillon told Lt. Hartwig the City is having Government Day on April 30th with some high school and grade school students and asked if would be possible to have some of the goggles that are used to make you feel you are under the influence while wearing them.. Lt. Hartwig said only the State Police has these, but he will get in contact with Officer Middlemas and he will contact the Mayor.
7. MAYOR DILLON Mayor Dillon reported to the City Council that he attended Community Coalition Meeting, which consists of Community Leaders, Bradley University and Law Enforcement for drug and alcohol abuse of high school and college students, On April 14th, he will be attending the Economic Development Commission Meeting and he and City Administrator Carlson will be attending the Heart of Illinois Mayor’s Association Meeting in Delavan. Mayor Dillon informed the City Council he received a phone call from a senior resident of West Peoria expressing her concern about the needs for her and other senior citizen about receiving assistance from organization or groups and asked it would bring her concern to tonight’s City Council Meeting. If any one is interested is interested in helping monetarily or with labor, please call City Hall.
8. PUBLIC COMMENT Township Supervisor DeSutter reminded everyone that Clean-Up Day will be Saturday, April 24th from 9:00 a.m. to 3:00 p.m. Volunteers are needed. Lunch will be served. Call Kelly Abraham if you are interested in helping.
9. MOTION TO APPROVE THE USE OF CITY BUILDINGS FOR THE LOCAL PUBLIC INFORMATION OFFICER (PIO) COMMITTEE was made by Alderman Dwyer and seconded by Alderman Dohm. Discussion: Alderman Dwyer stated this will allow the PIO to use the City Hall and the City Garage in case of emergency for a communication set up.

10. FOIA Attorney Connor advised the City Council about the State of Illinois changes at the State level and the Freedom of Information these changes came about he attended an IML Seminar on the changes with FOIA and Assistant Attorney General of Illinois spoke at this seminar. The City of West Peoria was in compliance. Attorney Connor focused on one portion of the FOIA and stated: If the City receives a request for a FOIA at any of the City’s facilities; the City Garage, City Hall, Bulletin board type of component for your website of the staff or council members an email that requires a FOIA request, even if you don’t open it up the City is deemed to have received it. He explained if you have an email account, CHECK IT. The Attorney General will say the City received this request and did not act on this on time; not acted on in five business days. Attorney Connor said if an email is sent to you at the City email address or any other address if you put it out to the public as a way to get in touch with you, even if you never opened that email the City is deemed to have received it. He stated always check your email, if not – do not have an official one. Economic Development Coordinator Pratt suggest the City creates Yahoo email addresses, he offered to work council member so they would be in compliance with FOIA Mayor Dillon asked if everyone should keep a hard copy of all their emails. Attorney Connor said do not delete any of the City’s related email and if you do delete get a FOIA and print it. City Administrator recommended everyone make hard copies of all City emails. Alderman asked if each Council member is their own FOIA monitor. Attorney Connor said yes. Alderman Dwyer suggested anytime we get anything concerning FOIA can we email this to Economic Development Coordinator Pratt to track.
11. ANNEXATION UPDATE Economic Development Coordinator reported the Annexation update to the council members. He stated the first part of this annexation was completed at the last meeting of the Babu and Hindu Temple property, they have signed the Annexation Agreement. Mayor and City Clerk will sign this Annexation Agreement after this meeting. This will finalize the Annexation Agreement. On April 20, 2010 the Plan Commission will hold a Public Hearing on four additional properties that will be annexed into West Peoria. You have all had the information about the properties and the annexation. On April 27, the City Council will hold an annexation hearing to annex those properties in the City of West Peoria. and there will be some additional action on those properties to allow the Zoning Board of Appeals to create Special Use Permits for these properties. The Sanitary District will have a Permitted Use and Special Use Permit for Sherri Hamilton property and the County property. The County has started the paper work at the corner of Farmington Road and Creek Road and the City is not sure if this will be done at the exact time of the Annexation the City is working on this on daily basis, talking with the property owners and to the City Attorney to have everything resolved and ready to go. Alderman Ganson asked if the Agreement goes through will this include any restrictions and how would the City enforce them? Attorney Connor stated the City could create an ordinance; this ordinance will have to be in place before the Agreement. Alderman Mathewson said if the City is allowing the Speedway to burn two times a year, this should be discussed with all the properties that are being annexed. They are in Limestone Township District. Will the City have an Intergovernmental Agreement to handle the burning violations? Alderman Dohm said Limestone District does not have burning ordinance. Alderman Mathewson said West Peoria does, how will we enforce our ordinance. Attorney Connor told the Council: the City can handle this like they do for all Ordinance violations. (The City cannot do is have the West Peoria Fire District put out the fires) Mayor Dillon said if a Fire Department gets a call, even though they do not have an ordinance, they have the authority to put the fire out. Alderman Mathewson asked about the Speedways Liquor License. Mayor Dillon said the City will add a classification.
12. MOTION TO APPROVE THE EXISTING CONSULTING TIF CONTRACT WITH THOMAS N. JACOBS ASSOCIATES, LTD. FOR THE SECOND HALF OF LEGAL FEES IN THE AMOUNT OF $1,497.50. (LINE ITEM 15-00-500) was made by Alderman Mathewson and seconded by Alderman Ganson.

13. MOTION TO APPROVE PAYMENT TO THE ECONOMIC DEVELOPMENT GROUP, LTD. FOR THE SECOND HALF OF 2009 PROFESSIONAL FEES IN THE AMOUNT OF $7,722.50 (LINE ITEM 15-00-500) was made by Alderman Mathewson and seconded by Alderman Dohm.

14. COMMITTEE REPORTS
A. FINANCE COMMITTEE Chair Mathewson reported the Finance Committee met on April 6th, the TIF Consultant attended this meeting and gave a good overview of the TIF amending of Phase I and some changes involved with this and a brief overview of the TIF Phase II. The committee reviewed all of the bills and went over next years budget. Alderman Mathewson congratulated City Administrator Carlson and the staff for coming up with the Budget. City Administrator told the council the Budget is on display at City Hall and will be on the agenda for the April 27th, City Council Meeting. Our next meeting will be May 4th, at 5:30 p.m. at City Hall.
B. LAND USE COMMITTEE Chair Dohm reported the Land Use Committee met on March 24th, the committee went Over the normal work and discussed the Waste Management Contract coming up. There will be a new Ordinance concerning Height issue on secondary structures. The committee discussed asphalt issues and went over our goal Alderman Dohm reminded council members about the Plan Commission Public Hearing on April 20th, at 5:30 at City Hall. Our next meeting will be April 21st, at 6:30 at City Hall.
C. PUBLIC SAFETY COMMITTEE Chair Dwyer reported the Public Safety Committee met on March 24th, the committee addressed the PIO Agreement that was passed tonight and discussed Waste Management issues. We went over the County taking over PAWS and the positive development for West Peoria and discussed the Babu Project. Our next meeting will be April 21st, at 5:30 at City Hall.
D. TRANSPORTATION COMMITTEE Chair Venzon reported the Transportation met on April 8th, discussed the normal housekeeping and reviewed the plans for Ashland Avenue and will go out on time. The committee discussed Sterling Avenue as the committee always with PPUATS coming up, the preliminary presentation about the different projects will be next week. Alicia is waiting on the IDOT traffic count on Farmington Road. The committee spent quite a bit of time on the budget. Alderman Venzon warned about speeding or driving in a hazardous manner in a construction zone. You will be ticketed. Take your time and go slow around the workers.
15. PUBLIC COMMENT Township Supervisor DeSutter reminded everyone about the April 24th Clean Up Day from 9: 00 a.m. to 3:00 p.m. Volunteers are needed. Lunch will be served. Items that will not be accepted: Paint, Electronics, Yard Waste Car tires will be $3.00 Truck tires will be $5.00
16. ADJOURNMENT Motion to adjourn this meeting was made by Alderman O’Neill and seconded by Alderman Ganson. Motion carried unanimously by voice. Meeting adjourned at 7:30 p.m.
