 OFFICIAL MINUTES OF SPECIAL MEETING

 WEST PEORIA CITY COUNCIL

 OF THE CITY OF WEST PEORIA, ILLINOIS

TUESDAY FEBRUARY 3, 2009

5:30 P.M.

WEST PEORIA CITY HALL

2506 W. ROHMANN AVENUE, WEST PEORIA IL

 

    A Special Meeting of the City Council of West Peoria, Illinois was held at the West Peoria City Hall

    on February 3, 2009.

 

   1.  CALL TO ORDER

        Meeting was called to order at 5:30 p.m. by Mayor Dillon.

 

   2.  PLEDGE OF ALLEGIANCE

        The Pledge of Allegiance was led by Mayor Dillon

 

   3.  ROLL CALL

        The following members were present: Alderman Dohm, Alderman Dwyer, Alderman

        Mathewson Alderman Meismer, Alderwoman Thomas and Alderman Venzon.

        Also present: Mayor James Dillon, Attorney Bill Connor, City Administrator John

        Carlson and City Clerk Carole Stephens.  Resident: Biddison.

        Plan Commission: Chair Carson, Dempsey, Furgiuele, Gilbert, Sharp, Swearingen.

        ZBA: McBride, Bennett Barker, Galloway and Topper.

        Alderman Ganson and Alderman Roberts were absent.

        Mayor Dillon announced that there is a quorum.

 

   4.  CERTIFICATION OF COMPLIANCE WITH THE OPEN MEETING ACT

        Attorney Connor said that this Special Meeting was posted and the Peoria Journal Star was notified. 

        Everything  was done in compliance with the Open Meetings Act.

 

   5.  ANNEXATION HEARING

        Attorney Connor recommended that a motion to hold an Annexation Hearing to be made.

        A motion to open an Annexation Hearing was made by Alderman Mathewson and seconded by

        Alderman Dwyer.

        ROLL CALL

        Mathewson, Dwyer, Dohm, Meismer, Thomas and Venzon

        Nays - 0

        Absent – 2 Alderman Ganson and Alderman Roberts

        Motion Carried.

        Discussion:  Mayor Dillon asked Gene Pratt to explain the sequence of events for tonight’s Special

        Meeting.

        Gene Pratt: The City Council will hold a Hearing  for annexation into West Peoria for:

        3106 W. Farmington Road, Mr. Biddison’s property. Once this is complete they will recess and the

        Plan Commission will start their meeting to consider the actual zoning classification. Once they

        complete that, the Plan Commission will adjourn their meeting and the City Council will reconvene

        their meeting and consider that zoning classification. The City Council will recess again and the ZBA

        will  convene their meeting to consider a Special Use Permit for selling cars on that property. The ZBA

        will  make a decision and complete their business and the City Council will reconvene their meeting

        and consider that recommendation.  Gene asked if anyone needed any additional information or

        would you like to hear from Mr. Biddison.

        Mayor Dillon asked if anyone have any questions for Mr. Biddison. 

        Alderman Mathewson asked Mr. Biddison what was his motivation to move into West Peoria?

        Mr. Biddison said that his neighbor had moved into West Peoria and he has been very happy with the  

        City.

        Mr. Biddison was asked how is his relationship with the county is. He said fine, he just thought that

        this  was the direction to go..

        Mayor Dillon said the county has changed some of their zoning and have gotten stricter.

        Mayor Dillon asked if there was any public at this meeting and would they like to ask any questions on

        this annexation. 

        There was no reply.

        Mayor Dillon asked for a motion to close the Hearing,

        Alderman Mathewson made a motion to close the Hearing and Alderman Meismer seconded the

        motion.       

        ROLL CALL VOTE  6 – Ayes Mathewson, Meismer, Dohm, Dwyer, Thomas and Venzon

        Nays – 0

        Absent – 2 Alderman Ganson and Alderman Roberts

        Motion Carried.

 

   6.  MOTION TO APPROVE AN AGREEMENT TO ANNEX PROPERTY AT 3106 W.

        FARMINGTON ROAD  was made by Alderman Mathewson and seconded by Alderman Dwyer.

        ROLL CALL VOTE Ayes – 6 Mathewson, Dwyer, Dohm, Meismer, Thomas and Venzon

        Nays – 0

        Absent – 2 Alderman Ganson and Alderman Roberts

        Motion Carried 

 

   7.  MOTION TO APPROVE ORDINANCE 2009-03 AN ORDINANCE ANNEXING PROPERTY AT

       3106 WEST FARMINGTON ROAD INTO THE CITY OF WEST PEORIA was made by Alderman

       Mathewson  and seconded by Alderman Dwyer.

       ROLL CALL VOTE Ayes – 6 Mathewson, Dwyer, Dohm, Meismer, Thomas and Venzon.

       Nays – 0

       Absent – 2 Alderman Ganson and Alderman Roberts

       Motion Carried

   

   8. MOTION TO APPROVE ORDINANCE 2009-04 AN ORDINANCE ZONING THE NEWLY

       ANNEXED PROPERTY AT 3106 WEST FARMINGTON ROAD AS B-2 was made by Alderman

       Mathewson and seconded by Alderman Dwyer.

       ROLL CALL VOTE Ayes – 6 Mathewson, Dwyer, Dohm, Meismer, Thomas and Venzon.

       Nays – 0

       Absent – 2 Alderman Ganson and Alderman Roberts

       Motion Carried

 

   9. MOTION TO APPROVE ORDINANCE 2009-05 AN ORDINANCE GRANTING A SPECIAL

       USE PERMIT FOR USED CAR SALES AND SERVICE was made by Alderman Mathewson and     

       seconded by Alderman Dwyer and/or Alderwoman Thomas.

       Discussion:  Alderman Dohm asked to amend the Ordinance 2009-05:

         1. Restrict the number of cars for display and sale to 50 on this particular lot.

         2. The size of each car space being 10 feet x 20 feet.

             This will set a precedent for us.

             Attorney Connor:  This motion will include the amendment

             Alderman Mathewson ask to amend his motion to include the amendment this was seconded by

             Alderman Mathewson asked if this 3106 W. Farmington Road is in Limestone School District and      

             Limestone Fire District?

             Alderman Dwyer:  Are there provision to get them covered by the West Peoria Fire District?

             Mayor Dillon: This is set by the State Statute that some of the tax money went to the Fire District.

             Mr. Biddison:  Asked if he would need a different tax number.

             Attorney Conner:  No.

        ROLL CALL VOTE: Ayes – 6 Mathewson, Thomas, Dwyer, Dohm Meismer and Venzon

        Nays – 0

        Absent – 2 Alderman Ganson and Alderman Roberts.

        Motion Carried

 

  10. OTHER BUSINESS

       None

 

  11. ADJOURNMENT

       Motion to adjourn was made by Alderman Meismer and seconded by Alderman Dwyer

       Motion carried unanimously by voice vote. Meeting adjourned by 6:40 p,m,.
