MINUTES SPECIAL MEETING ZONING BOARD OF APPEALS WEDNESDAY, JULY 14, 2010 5:30 P.M. WEST PEORIA CITY HALL 2506 W. ROHMANN AVENUE WEST PEORIA, ILLINOIS
1. CALL TO ORDER – The meeting was called to order By Chair McBride at 5:30 PM.
2. ROLL CALL – Members in attendance were: Chair McBride, Gerald Bennett- Barker and Eugene Topper. Kip Galloway and Cynthia Volk were not in attendance. Also in attendance were: City Administrator John Carlson, Economic Development Coordinator Gene Pratt and Code and Zoning Officer Dan Sullivan, Hazel Thomas, Jerry Meismer, William & Hazel Turner, Debbie & Ernie Albritton, Mindy Albritton, Jessica Albritton, Muriel Phenix, Paul Phenix, William Board, Julie Maras, Nora Leman, Chase Hendrick, Jan & Rick Martindale and Jim Albritton.
3. APPROVAL OF MINUTES OF THE LAST MEETING – 7/14/2010
4. CERTIFICATION OF COMPLIANCE WITH THE OPEN MEETINGS ACT – Chair McBride stated that the meeting was in compliance. The notice was published on June 29, 2010.
5. PUBLIC HEARING: Case no. 10-ZBA-03
Public Hearing to consider the granting of a variance for the undeveloped land next to 1409 N. Market Street (Tax ID 18-06-251-034), to allow an accessory structure (maintenance building) on property zoned R-1 without a primary structure.
A. MOTION TO OPEN PUBLIC HEARING – It was moved by Mr. Bennett-Barker and seconded by Mr. Topper to open the Public Hearing. B. SWEARING IN OF WITNESSES – City Clerk Carole Stephens swore in the witnesses. C. PROPERTY OWNER PRESENTATION – Mr. William Turner spoke about the properties he owns in West Peoria and he needs this storage building to store extra items from those properties, plus some other personal items. It will be a metal building with a driveway. D. OTHER WITNESS TESTIMONY – Mr. Sullivan showed pictures of the property and stated that even with the size of the building, the setbacks will be in compliance. He also stated that this building will help resolve any code issues concerning vehicles now stored on the property. E. MOTION TO CLOSE PUBLIC HEARING – It was moved by Mr. Bennett-Barker and seconded by Mr. Topper to close the Public Hearing.
6. CERTIFICATION OF FINDINGS OF FACT FOR: Case no. 10-ZBA-03 – Findings of Fact were read. It was moved by Mr. Bennett-Barker and seconded by Mr. Topper to approve the Findings of Fact.
7. CONSIDERATION AND POSSIBLE ACTION ON: granting of a variance for the undeveloped land next to 1409 N. Market Street (Tax ID 18-06-251-034), to allow an accessory structure (maintenance building) on property zoned R-1 without a primary structure – It was moved by Mr. Bennett-Barker and seconded by Mr. Topper to recommend the granting of the variance to the City Council. Mr. Bill Board asked to speak and City Clerk Carole Stephens swore him in. it was moved by Mr. Topper and seconded by Mr. Bennett-Barker to re-open the Public Hearing. Mr. Board asked if this would remain residential. Mr. Sullivan stated that it would remain so. It was moved by Mr. Bennett-Barker and seconded by Mr. Topper to close the Public Hearing.
8. PUBLIC HEARING: Case no. 10-ZBA-04
Public Hearing to consider the granting of a variance to allow a 71/2 foot fence like structure (privacy barrier) in back yard at 1008 N. Bluffcrest Court (Tax ID 18-06- 327-005).
A. MOTION TO OPEN PUBLIC HEARING – It was moved by Mr. Topper and seconded by Mr. Bennett-Barker to open the Public Hearing. B. SWEARING IN OF WITNESSES – City Clerk Carole Stephens swore in the witnesses. C. PROPERTY OWNER PRESENTATION – Mrs. Albritton spoke about the installation of their privacy barrier. They had started with replacing their fence and had the permit for it. Then they decided that they needed a privacy barrier so the neighbors cannot see into their backyard while they are swimming. They were told after it was installed that they would need a variance for the structure as it exceeded the allowed height requirement of the City. D. OTHER WITNESS TESTIMONY – Several people spoke on behalf of the Albrittons concerning the privacy issue with the neighbor. Mrs. Phenix and her son spoke on their behalf about their concerns with the privacy barrier. Mr. Sullivan showed pictures of each portion of the property in question. He stated that the regular fence is in compliance and that the privacy barrier can only be seen by the one neighbor. E. MOTION TO CLOSE PUBLIC HEARING – it was moved by Mr. Topper and seconded by Mr. Bennett-Barker to close the Public Hearing.
9. CERTIFICATION OF FINDINGS OF FACT FOR: Case no. 10-ZBA-04 – The Findings of Fact were read. It was moved by Mr. Topper and seconded by Mr. Bennett-Barker to approve the Findings of Fact.
10. CONSIDERATION AND POSSIBLE ACTION ON: granting of a variance to allow a 71/2 foot fence like structure (privacy barrier) in back yard at 1008 N. Bluffcrest Court (Tax ID 18-06-327-005) – It was moved by Mr. Topper to recommend to the City Council that this variance be granted. There was no second, thus the request was denied.

15. DETERMINATION OF FUTURE AGENDA – The next meeting will be on Tuesday, July 20, 2010 at 5:00 PM.
